These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User” or “You”) and Samplesphre (“Company,” “We,” “Our,” or “Us”). By accessing or using our sample packs, you agree to comply with these Terms. Please read this agreement carefully before making any purchases from Samplesphre.

1. License and Usage Rights

1.1. Royalty-Free License:

  • Subject to your compliance with these Terms and payment of applicable fees, Samplesphre grants you a non-exclusive, non-transferable, revocable, and royalty-free license to use the audio samples, loops, and content (“Sample Packs”) for your musical compositions, both for personal and commercial use.

1.2. Prohibitions:

  • You are expressly prohibited from reselling, distributing, or sublicensing the Sample Packs in their original, unaltered form. This includes offering the Sample Packs for sale or distribution to any third parties, whether for profit or otherwise.

1.2.1. Modification and Use in Compositions:

  • You are, however, granted the right to modify, edit, or adapt the Sample Packs to create your own original musical compositions. This means you may incorporate the Sample Packs into your compositions, subject to the terms of this agreement.  

1.3. Attribution:

  • While not mandatory, attribution to Samplesphre is appreciated when you use our samples in your compositions.

2. Intellectual Property Rights

2.1. Ownership:

  • You acknowledge that Samplesphre, its licensors, and the Company retain all rights, title, and interest in and to the Sample Packs, including all copyrights, trademarks, and other intellectual property rights. Usage of the Company’s name, Purchased Music titles, logo, designs and related marks without prior written permission is prohibited, except for promoting Purchased Music. Other names and marks on this Website are trademarks of their respective owners.

2.2. No Claim to User’s Work:

  • SAMPLESPHRE MAKES NO CLAIMS TO ANY OF YOUR ORIGINAL MUSICAL COMPOSITIONS CREATED USING OUR SAMPLE PACKS.

3. Use Restrictions

3.1. Prohibited Conduct:

  • You agree not to use the Sample Packs for any unlawful or unauthorized purpose, including infringing on the rights of others, engaging in illegal activities, or violating any applicable laws.

4. Warranties and Disclaimers

4.1. No Warranty:

  • Samplesphre provides the Sample Packs “as is” and makes no warranties regarding the accuracy, quality, or fitness for a particular purpose of our Sample Packs.

4.2. Limitation of Liability:

  • Samplesphre is not liable for any direct, indirect, special, incidental, or consequential damages arising from the use or inability to use our Sample Packs, even if we have been advised of the possibility of such damages.

5. Payment and Refunds

5.1. Payment:

  • You agree to pay the specified price for the Sample Packs you purchase from Samplesphre.

5.2. Refunds:

6. Modifications and Updates

6.1. Changes to Terms:

  • Samplesphre reserves the right to modify, update, and revise these Terms at any time. We encourage you to periodically review this page to remain informed of any updates, as they are legally binding.

7. Termination

  • Samplesphre may terminate your license and access to Sample Packs at any time if you breach these Terms. Upon termination, you must cease using our Sample Packs and destroy any copies.

  • These Terms are governed by and construed in accordance with the laws of India and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
